Welcome to HainesCPR. These terms and conditions outline the rules and regulations for the use of our services and website. By accessing this website and using our services, you accept these terms and conditions in full.
1. Introduction and Acceptance of Terms
Haines CPR provides First Aid, CPR (Cardiopulmonary Resuscitation), AED (Automated External Defibrillator), and related emergency response training conducted by instructors certified through the American Red Cross. Haines CPR also provides professional development training for Early Childhood Educators serving children from birth through five years of age.
By registering for, paying for, or participating in any course or training offered by Haines CPR, the participant agrees to be legally bound by these Terms and Conditions.
To initiate registration, participants must acknowledge acceptance of these Terms by checking the required box and submitting their full name through the Haines CPR Terms and Conditions Acceptance and Payment Google Form. Electronic acknowledgments, typed names, digital submissions, and registration system records shall constitute valid electronic acceptance of these Terms.
Submission of payment constitutes final acceptance of all Terms and Conditions, including the Cancellation and Refund Policy.
Haines CPR reserves the right to update or modify these Terms at any time. Updated Terms apply prospectively to future registrations and will be made available through the registration process or upon request.
2. American Red Cross Licensed Training Provider
Haines CPR is an independently owned and operated American Red Cross Licensed Training Provider ("LTP") authorized to deliver American Red Cross training and certification courses.
American Red Cross certification courses, online learning modules, certification requirements, and digital certification cards are provided in accordance with American Red Cross standards and licensing requirements.
Haines CPR is solely responsible for all business operations, including course registration, scheduling, payments, cancellations, refunds, customer service, and administration of its training programs. The American Red Cross is not a party to these Terms and Conditions and assumes no responsibility or liability for Haines CPR's business operations or policies.
References to the American Red Cross, its trademarks, course names, and certification materials are used solely under Haines CPR's Licensed Training Provider agreement.
3. Definitions
Haines CPR - "Haines CPR," "we," "our," and "us" refer to Haines CPR, a sole proprietorship owned and operated by Martha Haines.
Products/Services – All courses, certifications, workshops, training sessions, and related educational services provided by Haines CPR.
Customer/Participant – Any individual, group, or entity registering for or attending training.
Instructor/Trainer – Any individual authorized by Haines CPR to conduct training.
Sales Agreement – The binding agreement formed upon successful payment processing and confirmation of enrollment.
Blended Learning Course – Training requiring both online coursework and in-person skills assessment.
Instructor-Led Course – Fully in-person training without required online coursework.
Red Cross Learning Center (RCLC) – The American Red Cross online training platform used for course access and completion.
Voucher – an access code used to register for a training class.
Seat Reservation – an advance booking that guarantees a participant a spot in a specific class, workshop, or seminar.
4. Product Information
Haines CPR provides the following services:
- First Aid Training
- CPR Training
- AED Training
- Skills Boost Courses, including Asthma, Anaphylaxis, and Naloxone Administration
- Professional development training for Early Childhood Educators (birth–5 years)
All training is conducted in accordance with applicable American Red Cross standards where applicable. Certification is determined solely by American Red Cross or applicable third-party standards and is not controlled by Haines CPR.
Haines CPR is an independent training provider authorized to deliver American Red Cross courses and is not owned, operated, or controlled by the American Red Cross. Any policies, processing times, certification requirements, or digital platform functionality controlled by the American Red Cross remain subject to their policies and procedures.
5. Participation, Physical Ability, and Accommodations
Physical Demands
Participation in Haines CPR courses may require physical activity, including but not limited to kneeling, bending, lifting, repetitive chest compressions, rescue breathing simulations, operating training equipment, and performing other hands-on skills required by the American Red Cross curriculum.
Age Requirements and Minor Participants
Participants under eighteen (18) years of age must be registered by a parent or legal guardian, who must agree to these Terms and Conditions on the participant's behalf.
A parent or legal guardian must also complete and electronically sign the Haines CPR Minor Participant Liability Waiver and Assumption of Risk prior to the start of training. A minor may not participate in hands-on training unless the required waiver and parental or legal guardian authorization have been received by Haines CPR.
Additional supervision or participation requirements may apply depending on the nature of the training, course requirements, and the participant's age.
Medical Ability
By registering for a course, participants certify that they are physically capable of safely participating in the required training activities or will promptly notify the instructor of any medical condition, injury, disability, pregnancy, or physical limitation that may affect safe participation. Participants are responsible for determining, in consultation with their healthcare provider if necessary, whether they are medically able to participate in the course.
Assumption of Risk
Participants acknowledge that CPR and First Aid training involves inherent physical risks, including but not limited to muscle soreness, fatigue, bruising, minor strains, or other physical discomfort associated with repeated practice of emergency response skills. Participants voluntarily assume all risks associated with participation in classroom instruction and hands-on training activities.
Accommodations
Participants requiring reasonable accommodations should notify Haines CPR prior to the scheduled course whenever possible. Haines CPR will make reasonable efforts to provide accommodations consistent with applicable law and American Red Cross course requirements. However, accommodations cannot alter or waive required American Red Cross performance standards necessary for successful course completion and certification.
Indemnification
To the fullest extent permitted by applicable law, participants agree to indemnify, defend, and hold harmless Haines CPR, its owners, instructors, employees, agents, and representatives from and against any claims, demands, damages, losses, liabilities, costs, or expenses, including reasonable attorney's fees, arising out of or related to the participant's enrollment in or participation in the training, except to the extent caused by the gross negligence or willful misconduct of Haines CPR.
6. Code of Conduct
Haines CPR is committed to providing a safe, respectful, inclusive, and professional learning environment for all participants, instructors, and staff.
All trainers and participants are expected to conduct themselves in a professional manner at all times and to treat others with courtesy, respect, and dignity. Discrimination, harassment, intimidation, bullying, disruptive behavior, or inappropriate conduct of any kind will not be tolerated.
Haines CPR does not discriminate on the basis of race, color, religion, sex, age, national origin, disability, marital status, veteran status, sexual orientation, gender identity, or any other protected status under applicable federal or West Virginia law.
Participants and trainers are expected to maintain appropriate communication, follow all class expectations, participate respectfully, and comply with all safety procedures and instructor directions during training sessions.
Any behavior that disrupts the learning environment, creates safety concerns, or violates this Code of Conduct may result in removal from the training session without refund and may result in denial of future enrollment.
Haines CPR reserves the right to refuse service or participation to any individual whose behavior is deemed unsafe, inappropriate, or inconsistent with the professional standards of the training program.
7. Pricing and Payment
Pricing varies depending on the specific course selected.
Full payment must be successfully processed prior to the start of any in-person American Red Cross course, enrollment in any blended learning course, or any additional training session provided by Haines CPR.
Failure to submit payment prior to class will result in removal from the course roster and denial of participation.
By submitting payment, participants acknowledge they have read and agree to these Terms and Conditions.
8. Intellectual Property
All course materials, handouts, presentations, forms, training documents, policies, website content, graphics, logos, examinations, videos, online learning content, instructor presentations, skills demonstrations, and other materials created or provided by Haines CPR are the intellectual property of Haines CPR unless otherwise identified and are protected by applicable copyright, trademark, and other intellectual property laws.
American Red Cross® names, logos, course materials, certification cards, and trademarks are the property of the American National Red Cross and are used by Haines CPR solely under its Licensed Training Provider agreement. Nothing in these Terms and Conditions grants participants any ownership interest in, or license to reproduce, distribute, modify, publish, transmit, display, or commercially use American Red Cross materials.
Course materials are provided solely for the participant's personal educational use. Except as expressly permitted by applicable law or with the prior written permission of Haines CPR or the applicable intellectual property owner, participants may not copy, reproduce, photograph, audio record, video record, livestream, download, distribute, transmit, publish, sell, modify, create derivative works from, or otherwise use or share any course materials, instructor presentations, skills demonstrations, examinations, online learning content, or other proprietary materials. Unauthorized use of these materials may result in removal from training, denial of certification processing where permitted by applicable course requirements, legal action, and any other remedies available under applicable law.
9. Digital Registration and Service Delivery
All courses, training sessions, certifications, registrations, online learning modules, digital materials, and seat reservations provided by Haines CPR are considered intangible educational services and digital products.
Submission of payment and registration for any course constitutes the purchase of a non-tangible educational service and reserves a seat in a scheduled training session or course offering.
Class sizes are limited, and enrollment is accepted on a first-paid, first-reserved basis. Payment for a course reserves a specific seat in a training class and removes that seat from availability to other potential participants. Once a seat is reserved, Haines CPR immediately allocates instructor time, training resources, administrative processing, course materials, and, where applicable, American Red Cross course access and digital learning modules associated with that enrollment. Because each reserved seat represents a limited training opportunity that cannot be offered to another participant and because costs are incurred immediately upon registration, registrations become binding upon payment and are subject to the Cancellation and Refund Policy outlined in these Terms and Conditions.
Participants acknowledge and agree that:
- Digital course registrations and seat reservations are non-transferable unless approved by Haines CPR;
- Payment processing initiates administrative, scheduling, and instructional costs immediately upon registration; and
- Reservation of a seat may prevent another participant from enrolling in the same training session.
Haines CPR reserves the right to deny refund requests that are inconsistent with these Terms and Conditions or that involve reserved class seating, issued course vouchers, enrollment in the Red Cross Learning Center (RCLC), activated online learning modules, transmission of digital course materials, or attendance at any portion of instruction.
Enrollment Process
Upon successful payment:
- The participant is added to the class roster;
- A confirmation email containing course information and enrollment details will be sent; and
- Any applicable course voucher or access information will be issued.
Blended Learning Courses
For Blended Learning Courses:
- A course voucher will be claimed using the participant's registration information, including first name, last name, and email address;
- The participant will be enrolled in the Red Cross Learning Center (RCLC);
- Access to required online learning modules will be provided; and
- An automated email containing instructions for accessing and completing the online coursework will be sent through Salesforce Automation.
Instructor-Led Courses
For fully in-person Instructor-Led Courses:
- The participant will attend the scheduled classroom training session; and
- The course record entry will be completed upon successful completion of all course requirements.
Issuance of course vouchers, enrollment in the Red Cross Learning Center (RCLC), access to digital learning modules, transmission of course-related digital materials, confirmation of enrollment, or reservation of class seating constitutes delivery of educational services and fulfillment of a portion of Haines CPR's obligations under the participant's registration.
10. Certification Requirements and Delivery of Certificates
Enrollment in or payment for a Haines CPR course does not guarantee successful course completion or the issuance of a certification.
Participants must successfully complete all course requirements established by Haines CPR and, where applicable, the American Red Cross. Requirements may include attendance for the full course, completion of all required online learning modules, successful completion of written knowledge assessments, demonstration of all required practical skills, and achievement of the minimum performance standards established by the American Red Cross.
Successful certification is contingent upon satisfactory completion of all required course components and skills evaluations in accordance with American Red Cross standards. Participants who do not successfully demonstrate the required skills or otherwise fail to meet the applicable performance standards will not receive certification.
Payment purchases instruction, evaluation, course materials, instructor time, administrative services, facility costs, seat reservation, and, when applicable, access to American Red Cross course materials. Certification is awarded solely upon successful completion of all applicable course requirements established by Haines CPR and, where applicable, the American Red Cross. Payment does not guarantee successful course completion or the issuance of an American Red Cross certification card.
Upon successful completion of all course requirements, certificates will be issued to the email address provided by the participant.
For American Red Cross courses, certification records and digital certificates are typically available through the American Red Cross Learning Center within approximately 72 hours following successful course completion. Processing times may vary and are subject to American Red Cross systems and procedures.
Participants are solely responsible for monitoring the expiration of their certifications and registering for renewal training before expiration when required.
11. Cancellation and Refund Policy
Course registrations become final after twenty-four (24) hours from payment processing. Refund eligibility after that period is limited as outlined below.
Participants may request cancellation of a course registration by contacting Haines CPR in writing by email.
- Cancellation requests received within twenty-four (24) hours of payment may be eligible for a refund of the amount paid, less ten percent (10%) to cover non-refundable payment processing, transaction, and administrative fees.
- Registration for Early Childhood Professional Development training courses, whether delivered in person, virtually, or through a hybrid format, reserves a limited training seat and constitutes the purchase of an intangible educational service. Cancellation requests submitted more than twenty-four (24) hours after payment will not be approved. Once a training seat has been reserved, that seat is removed from available inventory and may not be resold.
- Cancellations for American Red Cross courses requested after the initial 24-hour period will be subject to a $10 cancellation fee and will only be approved if voucher issuance has not yet occurred. Once a voucher has been issued or course access has been provided, the registration is considered a non-refundable intangible service and no refunds, cancellations, or exchanges will be permitted.
- Any fees incurred by Haines CPR for voucher issuance, online course activation, or American Red Cross enrollment are non-refundable once processed.
- Refunds will not be issued if the participant has completed any American Red Cross online training modules or if the participant’s course status appears as ‘In Progress’ or ‘Completed’ within the instructor’s Red Cross Learning Center (RCLC) dashboard.
- Refunds will not be issued after completion of the in-person skills session or instructor-led course.
- Approved refunds will be processed to the original form of payment whenever possible.
Refunds will not be issued under the following circumstances:
- Failure to attend class
- Failure to complete the required online portion of a Blended Learning course
- Failure to pass the skills assessment as certification is a separate third-party evaluation requirement and outcome (American Red Cross controlled). Payment is for instruction and seat reservation, not certification outcome.
- Failure to fully participate in the class
- Failure to remain for the full duration of the class
- Failure to provide proof of online course completion before attending the in-person skills session
Refunds or transfers will be granted only as permitted under this policy.
Payment and Attendance Policy
- Full payment must be received prior to the start of any class. Participants who do not submit payment will not be permitted to participate in training.
- Failure to complete all required online training modules for Blended Learning courses prior to the scheduled in-person skills session will result in denial of participation in the skills session and forfeiture of payment. Completion of the online portion is a prerequisite for attendance at the in-person skills session.
- If a participant is unable to attend the scheduled in-person skills session or instructor-led training, the participant must notify Haines CPR no later than twenty-four (24) hours before the scheduled session to request a one-time rescheduling. Exceptions to the twenty-four (24) hour notice requirement may be granted at the sole discretion of Haines CPR and may require proof of the circumstances giving rise to the request. Any exception granted shall apply only to the specific circumstances presented and shall not constitute a waiver of any provision of these Terms and Conditions or create any obligation for Haines CPR to grant similar exceptions in the future.
- Failure to provide timely notification, failure to reschedule, or failure to attend an alternative in-person skills session or instructor-led training within 90 calendar days from the completion of the online training modules will result in forfeiture of payment.
- Participants who forfeit payment will be required to submit a new registration and full payment to enroll in a future course.
- For Blended Learning Courses, participants must complete the in-person skills session within 90 days of completing the online portion as per American Red Cross requirements.
- Failure to complete the in-person session within 90 days will require the participant to repeat the online portion at their own expense.
Proof of Attendance
Upon arrival to any in-person training, all participants are required to sign-in on a class roster. The roster will be used as a record of attendance. Participants will also acknowledge that the instructor has verified completion of any online training modules, if applicable, and identification.
Attendance rosters, email communications, payment records, Google Form acknowledgments, RCLC enrollment records, and online module completion records may be used as evidence of service delivery and participant agreement to these Terms and Conditions.
12. Instructor Cancellation
Haines CPR reserves the right to reschedule or cancel classes due to illness, emergency, severe weather, low enrollment, or circumstances beyond our control.
In such cases, participants will be offered two (2) different dates to attend an alternate session.
Rescheduled classes will be offered within 45 calendar days of the original scheduled date whenever reasonably possible. If Haines CPR is unable to provide an alternate training date within a reasonable period of time, a refund may be issued.
13. Privacy Policy
Third-Party Providers
Haines CPR shares necessary participant information with the American Red Cross for registration and certification purposes.
Payment processing is handled through Strips, PayPal and PayPal Zettle for Point of Sale. Participants are subject to the privacy policies of those third-party providers.
Haines CPR uses Google Forms, a third-party service provided by Google LLC, to collect participant registration information, course selections, electronic acknowledgments, and digital acceptance of these Terms and Conditions. Information submitted through Google Forms is transmitted and stored using Google's services and is subject to the Google Privacy Policy. Participants acknowledge that registration information submitted through Google Forms will be used solely for course registration, communication, certification, recordkeeping, and other purposes related to the administration of Haines CPR training services.
Electronic Communications
By registering for a course, participants consent to receive communications from Haines CPR electronically, including but not limited to registration confirmations, payment receipts, course reminders, schedule updates, online learning instructions, certification notifications, and other communications related to course administration. Participants are responsible for providing and maintaining a valid email address and for checking their email, including spam or junk folders, for important course-related communications. Haines CPR is not responsible for delays or failures in delivery resulting from incorrect contact information, spam filters, or technical issues beyond its reasonable control.
Haines CPR is not responsible for the privacy practices or policies of third-party providers.

14. Limitation of Liability
Haines CPR provides educational and certification services only and does not guarantee employment, licensure, regulatory compliance, or any professional or employment outcome beyond successful course completion and, where applicable, issuance of certification.
Haines CPR shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to participation in training courses, scheduling conflicts, missed certifications, participant failure to meet certification requirements, third-party system failures, or certification processing delays caused by outside organizations, including but not limited to the American Red Cross or PayPal.
Participants are solely responsible for completing all course requirements within applicable timeframes and for meeting any employer, licensing, certification, or regulatory requirements applicable to their employment or profession.
To the fullest extent permitted by applicable law, Haines CPR's total liability arising from any claim relating to a participant's registration or attendance shall not exceed the amount paid by the participant for the applicable course.
Educational Services Disclaimer
Haines CPR provides educational instruction in First Aid, CPR, AED, emergency response, and professional development training. Training is intended solely to teach knowledge and practical skills and does not constitute medical, legal, employment, or professional advice. Completion of a course does not authorize participants to practice medicine or provide care beyond the scope of the applicable certification or governing law. Participants remain responsible for exercising independent judgment and complying with applicable laws, employer policies, licensing requirements, and emergency medical protocols when responding to an emergency.
Information presented during professional development courses is provided for educational purposes only and should not be interpreted as legal, licensing, regulatory, or professional advice. Participants are responsible for ensuring compliance with applicable federal, state, local, licensing, and employer requirements.
Equipment Sanitation
Haines CPR is committed to maintaining a clean and safe training environment. All CPR mannequins, AED trainers, barrier devices, and reusable training equipment are cleaned and sanitized between training sessions in accordance with current American Red Cross instructor guidance and applicable manufacturer recommendations.
Despite these sanitation procedures, participants acknowledge that participation in in-person training involving shared equipment and interaction with other participants carries an inherent risk of exposure to communicable illnesses, including, but not limited to, viral, bacterial, fungal, or other infectious diseases. No sanitation protocol can completely eliminate the risk of disease transmission.
Communicable Disease Acknowledgment
Participants agree they will not attend training if they are experiencing symptoms of a contagious illness, have been advised by a healthcare provider or public health authority to isolate due to a communicable disease, or reasonably believe they may expose others to an infectious illness.
By voluntarily participating in training, participants acknowledge and assume these inherent health risks. To the fullest extent permitted by applicable law, Haines CPR shall not be liable for illness, infection, or disease allegedly arising from participation in a training course when reasonable sanitation practices have been followed.
15. Dispute Resolution
Disputes arising out of or relating to these Terms and Conditions or the services provided by Haines CPR shall first be addressed through good-faith informal resolution between the parties.
If a resolution cannot be reached, any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the services provided by Haines CPR shall be resolved exclusively through binding arbitration, except where small claims court jurisdiction applies or where arbitration is prohibited by applicable law. Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect, or any successor rules applicable to the dispute. Arbitration may be conducted in person or remotely, as permitted by the applicable arbitration rules or as agreed by the parties.
This agreement to arbitrate shall be governed by and interpreted in accordance with the Federal Arbitration Act (9 U.S.C. §§ 1–16). Except as otherwise provided in this arbitration provision, these Terms and Conditions shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles.
Arbitration fees, costs, and expenses shall be allocated in accordance with the applicable arbitration rules and governing law, unless otherwise agreed by the parties or ordered by the arbitrator.
Class Action Waiver
To the fullest extent permitted by applicable law, participants agree that all disputes shall be resolved solely on an individual basis. Participants waive any right to participate in any class action, collective action, representative action, consolidated proceeding, or private attorney general action arising out of or relating to these Terms and Conditions or the services provided by Haines CPR.
Court Proceedings
To the extent any dispute is permitted to proceed in court rather than arbitration, the parties agree that exclusive jurisdiction and venue shall lie in the state or federal courts located in Monongalia County, West Virginia, and each party consents to the personal jurisdiction of those courts.
Severability of Arbitration Provision
If any provision of this arbitration agreement or Class Action Waiver is determined to be invalid or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect to the fullest extent permitted by applicable law.
16. Force Majeure / Chargeback / Payment Dispute Policy
Force Majeure
Haines CPR shall not be liable for any delay, postponement, rescheduling, cancellation, or inability to provide services resulting from events beyond its reasonable control, including but not limited to severe weather, natural disasters, public health emergencies, pandemics, government actions, utility outages, facility closures, labor disputes, instructor illness or injury, transportation disruptions, or any other event beyond the reasonable control of Haines CPR. In such circumstances, Haines CPR may reschedule training or provide another reasonable remedy at its sole discretion. Haines CPR shall not be considered in breach of these Terms and Conditions as a result of any such event.
Chargeback / Payment Dispute Policy
By completing payment and agreeing to these Terms and Conditions, the participant acknowledges that all services are considered delivered upon issuance of course access, enrollment confirmation, voucher activation, or reservation of a training seat.
Participants agree to first contact Haines CPR directly to resolve any billing concerns prior to initiating a payment dispute or chargeback.
Haines CPR reserves the right to respond to any dispute or chargeback with supporting documentation, including but not limited to attendance records, electronic acknowledgments, enrollment confirmations, payment records, and course access logs.
By submitting payment, the participant authorizes Haines CPR to provide transaction records, enrollment records, attendance records, course access records, electronic acceptance records, and other relevant documentation to payment processors, financial institutions, card issuers, arbitration providers, or courts for the purpose of resolving payment disputes.
Filing payment disputes or chargebacks that are inconsistent with these Terms may result in denial of future registration privileges with Haines CPR.
17. General Provisions
Severability
If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions constitute the entire agreement between Haines CPR and the participant regarding the services provided and supersede all prior or contemporaneous oral or written discussions, representations, advertisements, or agreements relating to those services. No modification or waiver of these Terms shall be effective unless made in writing by Haines CPR.
No Waiver
Failure by Haines CPR to enforce any provision of these Terms and Conditions, or any delay in exercising any right or remedy, shall not constitute a waiver of that provision, right, or remedy. Any waiver by Haines CPR must be made in writing and shall apply only to the specific instance for which it is given.
